Oklahoma Drug Trafficking Penalties

Oklahoma drug trafficking penalties are some of the harshest under Oklahoma criminal law. Many people are surprised to learn how easily it is to be charged with drug trafficking in Oklahoma. Possession of ten (10) grams of heroin, five (5) grams of crack cocaine, or one (1) ounce of PCP will trigger the drug trafficking statute. Possession of twenty five (25) pounds of marijuana, twenty eight (28) grams of powder cocaine, or twenty (20) grams of methamphetamine (meth) will also trigger the drug trafficking statute. Possession of larger quantities of drugs can be charged as aggravated trafficking. A first offense for drug trafficking carries from 4 years to life in prison and fines ranging from $20,000 to $500,000. A second offense carries from 6 years to life in prison and fines ranging from $20,000 to $500,000. If a person has two or more prior drug felony convictions, trafficking carries life in prison without the possibility of parole (LWOP) and fines ranging from $20,000 to $500,000. Trafficking charges are ineligible for deferred sentences, suspended sentences, probation, or good behavior credits while in prison.
